Ports are called the economic window on the world. The development of this sector in recent years has resulted mainly from multi-billion dollar investments in new terminals and port infrastructure and multifold increase in port transhipment. This entails a number of accompanying investments – construction of logistics centres, construction of new roads, development of forwarding and transport companies.
As a Law Firm with its seat in Gdańsk, from the very beginning of our operations, we have been providing advice on ports and port investments. We advised companies implementing port investments on the basis of agreements concluded with entities managing sea ports and harbours; in particular, our lawyers provided legal services during the process of construction of the largest container terminal in Poland. Our advisory services are comprehensive: from the moment of preparation of contracts related to the acquisition of port properties, preparation and implementation of the investment, until its commissioning. Furthermore, we provide day-to-day legal services to companies operating in ports. The lawyers of the firm have also gained extensive experience in the implementation of investments co-financed by the European Union, as well as in public-private partnership projects. We took part in the process of giving opinion on legislative changes in the field of seaport activities.
Maritime Law
The Law Firm provides comprehensive services in the area of maritime law. We advise our clients on ship registration, rights in rem on ships (maritime mortgage and other rights in rem), maritime accidents and related damages, arrests of ships, maritime insurance, preparation and negotiation of shipbuilding or ship repair contracts, agency and brokerage contracts, as well as claims related to damage to a ship in a port and damage to port infrastructure located in ports.
Port investments
We advise companies carrying out port investments on the basis of agreements concluded with entities managing seaports and harbours. Our advice is comprehensive: from investment preparation until its commissioning, we help to obtain all administrative permits and conclude the necessary agreements, including construction work and subcontracting contracts. Our lawyers have extensive experience in the implementation of investments financed from the state or European Union budget, as well as public-private partnership projects.
Cargo carriage by sea
Our lawyers provide services to ship-owners and freight forwarding and transportation companies dealing with the provision of cargo transportation services. Our clients’ portfolios include both liner shipping companies as well as smaller companies that provide forwarding services.
Transport
We have extensive experience in providing services to entities conducting business activity in the field of goods transport (including the Act on Road Transport, the Act on Transport Law, CMR Convention). For our customers we develop extensive transport and forwarding contracts, as well as transport and forwarding orders. Our lawyers provide legal advice on third party liability insurance for carriers and/or forwarders, and represent clients in disputes with insurers. We advise on matters concerning carrier’s and forwarder’s liability for the shipment. We handle inspections carried out by the Road Transport Inspection, in particular with regard to drawing up appeals against the decisions of authorities issued as a result of inspections. We also provide services to entrepreneurs in all legal aspects concerning the employment of drivers (employment contracts, allowances, minimum wage, work regulations).
Logistics
The Law Firm advises clients conducting business activity in the TSL sector. We provide comprehensive services for investments involving the construction and launch of warehouses and logistics centres. We prepare and negotiate storage and warehousing contracts. We support entrepreneurs in obtaining quality certificates (including ISO, MSC, BRC). We offer legal services concerning conducting business activity in free zones, free warehouses, special economic zones, ports and harbours, among others, in the scope of obtaining appropriate permits and administrative decisions.
